1Acceptance

By creating an account or using the Mon Déneigeur platform, you agree to these Terms of Use in their entirety. If you do not accept these terms, you must stop using the service.

These terms apply to all use of Mon Déneigeur, including the entrepreneur dashboard, the operator application, the client portal and all associated APIs.

2Nature of service and legal relationships

Three distinct legal relationships govern the use of Mon Déneigeur:

2.1 — Plomberie RJ Léveillée Inc. ↔ Subscribers (snow removal entrepreneurs)

These terms form a Software as a Service (SaaS) agreement between Plomberie RJ Léveillée Inc. ("Mon Déneigeur") and snow removal entrepreneurs who subscribe ("subscribers").

Mon Déneigeur provides a technology platform for managing routes, operators, clients and notifications. Mon Déneigeur does not provide snow removal services and is not the employer of any snow removal operators.

2.2 — Subscriber ↔ their clients (residents)

The subscriber provides snow removal services to their own residential or commercial clients. This service contract is separate from these terms and Mon Déneigeur is not a party to it.

The subscriber remains solely responsible to their clients for the quality, safety and compliance of their snow removal services, including obligations under the Civil Code of Quebec.

2.3 — Mon Déneigeur ↔ Subscribers' clients (residents)

Mon Déneigeur has no direct contractual relationshipwith subscribers' clients. These individuals use the tracking portal and receive notifications for informational purposes only.

Mon Déneigeur is a technology platformand assumes no responsibility toward subscribers' clients for snow removal services rendered to them. Any complaint regarding the quality of snow removal must be addressed directly to the contractor (the subscriber).

  • Billing: annual, at time of subscription. Managed via Stripe.
  • Renewal: subscriptions renew automatically each year unless cancelled before the renewal date.
  • Refunds: no prorated refunds for mid-period cancellations, except where required by law.

5GPS and geolocation consent

The Mon Déneigeur operator application collects the operator's GPS position during active snow removal runs. This collection is subject to the following rules:

  • Explicit consent: each operator must explicitly accept GPS collection on their first use of the application. This consent is recorded with a timestamp (Law 25, s. 12).
  • Limited collection: GPS data is only collected during active snow removal runs. No background collection.
  • Retention: raw GPS points are automatically deleted after 90 days. Service completion records (GPS punch at ✓ Done) are retained as proof of service.
  • Revocation: operators can revoke consent by removing the location permission in their device settings. This will disable position tracking.
Subscriber obligation: Subscribers agree to inform their operators of GPS collection and ensure they have given informed consent before using the application.

6Limitation of liability

The service is provided "as is" and "as available." Mon Déneigeur commits to maintaining reasonable availability but does not guarantee uninterrupted service.

Liability cap: The total liability of Mon Déneigeur toward a subscriber is limited to the amount paid during the 12 months prior to the event giving rise to the claim (Civil Code of Quebec, art. 1474).

This cap does not apply to intentional fault, gross negligence, or bodily injury, in accordance with articles 1474 and 1477 of the Civil Code of Quebec.

Exclusion for snow removal services: Mon Déneigeur is in no way liable for damages, injuries, losses or claims arising from snow removal services provided by the subscriber to their clients. The subscriber is solely responsible for the quality, safety and compliance of their services.

7Intellectual property

Mon Déneigeur and all its components (source code, interface, trademarks, logos, texts, images) are the exclusive property of Plomberie RJ Léveillée Inc.

The subscriber retains ownership of all data they enter into the platform (client lists, routes, notes, photos). Mon Déneigeur claims no rights over this data.

The subscription grants the subscriber a non-exclusive, non-transferable, revocable licence to use the software, limited to the duration of the active subscription.

8Service changes

Mon Déneigeur reserves the right to modify, suspend or discontinue all or part of the service with reasonable notice, except in cases of emergency or force majeure.

Material changes to these terms will be communicated by email at least 30 days before taking effect. Continued use of the service after this period constitutes acceptance of the updated terms.

9Termination

9.1 — Termination by the subscriber

Subscribers may cancel their subscription at any time from the dashboard or by contacting support. Access is maintained until the end of the current subscription period.

9.2 — Termination by Mon Déneigeur

Mon Déneigeur may terminate or suspend an account without notice for violation of these terms, fraud or abuse. In other cases, 30 days' notice by email will be provided.

Any dispute arising from these terms or the use of the service shall be subject to the exclusive jurisdiction of the courts of the province of Quebec. For disputes valued at less than $15,000, the Small Claims Division of the Court of Quebec has jurisdiction.
